Privacy Notice

(If you are reading this Privacy Notice on behalf of a body corporate/business enterprise which maintains/maintained a contractual relationship with SainoForce Technology, this Privacy Notice is intended to be addressed to, without limitation, the individual officers (e.g., authorized signatories/dealer and company secretary), directors, shareholders, beneficial owners (e.g., sole proprietor and partners), guarantor, or obligor of the body corporate/business enterprise (the “Relevant Individuals”) and “you” shall be construed accordingly to mean the Relevant Individuals).

At SainoForce Technology, we value your privacy and strive to protect your personal information in compliance with the laws of Malaysia.

Pursuant thereto, this Privacy Notice is designed to explain and elaborate upon some of our policies and principles pertaining to the privacy of your personal information, all of which we have adopted as a sign of our commitment to respecting, maintaining, protecting, and safeguarding the privacy of your personal information.

SainoForce Technology will only collect, record, hold, use, disclose, and store (i.e., "process") your personal information in accordance with such laws (including the Personal Data Protection Act 2010 and other applicable data protection or privacy laws/regulations), this Privacy Notice, and the privacy terms in your agreement(s) with SainoForce Technology that you may have contracted with.

This Privacy Notice explains:

  • The type of personal information we collect and how we collect it;

  • How we use your personal information;

  • The parties that we disclose the personal information to; and

  • The choices we offer, including how to access and update your personal information.


1. Our Commitment
1.1 We will safeguard, according to strict standards of security and confidentiality, any information our customers share with us.
1.2 We will limit the collection and use of customer information to the minimum as may be required to deliver superior service to our customers, which includes advising our customers about our products, services, and other opportunities, and to administer our business.
1.3 We will permit only authorized employees, who are trained in the proper handling of customer information, to have access to that information.
1.4 Whenever we hire other organizations to provide support services, we will require them to conform to our privacy standards.
1.5 To make sure your personal information is secure, we communicate our privacy and security guidelines to SainoForce Technology employees and strictly enforce privacy safeguards within the company.

 

2. What Kind Of Personal Information We Collect And How We Collect It
2.1 If you are below the age of eighteen (18), you are responsible for obtaining consent from your parent, guardian, or person who has parental responsibility, prior to disclosing your personal details to SainoForce Technology. SainoForce Technology shall not be liable for any loss or inconvenience to you for failing to obtain consent.
2.2 In order to enable us to perform our services, offer our products to you, deal with your inquiries, open and operate an account for you, and/or to fulfill partly or all of the services requested by you, we may need to and/or be required to process personal information and data about you, including but not limited to:
a. Personal information typically collected on application forms, which include but are not limited to your name, address details, date of birth, telephone number, mobile phone number, and email addresses;
b. Personal information that pertains to you obtained indirectly through other sources (if any), in respect of which you have given your consent to them disclosing information relating to you and/or where they are not otherwise restricted including but not limited to, information about your interactions with SainoForce Technology and other merchants and the products and services you have purchased using our products;
c. Information which we may collect from written communication when you provide us complaints or issue of inconveniences while using our service and we may use it for the purposes of communicating with you and to efficiently manage your requests and to resolve any other issues you may face;
d. Information such as language, postcode, area code, unique device identifier, location, and the time zone where the SainoForce Technology products or services are used;
e. Information regarding customer activities on our websites and from our other products and services, which are aggregated and used to help us provide more useful information to our customers and to understand which parts of our websites, products, and services are of most interest;
f. Information relating to your activities, habits, preferences, and interests arising from your use of products and services of SainoForce Technology, our partners or vendors; and/or
g. Other electronic data or information relating to you such as IP addresses, cookies, activity logs, online identifiers, and location data through your usage of our products and services or as part of their supply or delivery to you.
2.3 We may obtain this information from yourself and from a variety of sources, including but not limited to:
a. Through your relationship with us, for example, information provided by you in application forms (physical or online through the SainoForce Technology Portal), when you register and operate your account and use our products or services, when taking part in customer surveys, competitions, and promotions, when providing feedback or making complaints;
b. Through your verbal and written communications with us and/or our authorized agents via SMS, phone or mobile device, email, fax, mail, websites or browsers, social media, and/or any other appropriate communication channels;
c. From any information that is supplied and/or collected when you visit our websites and/or download our mobile device applications which may include your device's IP address or from data that is collected via cookies.
2.4 We use cookies (or equivalent technologies) for a number of purposes, including to store your preference for certain types of information or products, further analysis for the purpose of providing products and services to you, to improve our products and/or to personalize our services to you. Cookies are small text files that collect information about users and their visit to the website or use of the app, such as their Internet protocol (IP) address, how they arrived at the website (for example, through a search engine or a link from another website), and how they navigate within the website or mobile application.
2.5 We may use third parties to track its advertising across the web. The information we or these third parties collect does not include any personal information but is merely for the purpose of identifying the general effectiveness of such online advertising.
2.6 You may adjust settings on your browser and/or mobile device so that you will be notified when you receive a cookie or other similar tracking tools. Please refer to your browser documentation to check if the tracking tools have been enabled on your computer and/or mobile device or to request not to receive cookies or to disable cookies if you do not wish to have information collected via the use of cookies. However, do note that if you enable blocking or disabling of cookies, it may limit certain features and functions in your use of our web or mobile sites and that some personalized services on our websites may not be available if you choose to disable cookies.

Third-Party Sites and Services
2.7 Our websites, products, applications, and services may contain links to third-party websites, products, and services. Our products and services may also use or offer products or services from third parties. Information collected by third parties, which may include such things as location data or contact details, are governed by their privacy practices. This means third-party internet sites that you can link through our websites are not covered by our policy. Therefore, we encourage you to familiarize yourself with those third parties’ sites’ privacy policies before using the links or applications and we urge you to be careful when you enter any personal information online. SainoForce Technology accepts no responsibility or liability for those sites.

 

3. How We Use Your Personal Information
3.1 Other than as stated above, we may use your personal information for one or more of the following purposes:
a. To assess, address or fulfill your registration, orders, usage, subscription and/or requests, and any other issues regarding the products or services you have requested, including resolving any issues or disputes;
b. To respond to your inquiries and complaints and to resolve disputes;
c. To provide you with information and updates on the products and services you have subscribed to;
d. To manage and maintain your account and facility with us;
e. To verify your financial standing through credit reference/reporting checks;
f. To update, consolidate and improve the accuracy of our records;
g. To produce data, reports, and statistics which have been anonymized or aggregated in a manner that does not identify you as an individual;
h. To meet the disclosure requirements of any law binding on SainoForce Technology;
i. For audit, compliance, and risk management purposes;
j. To assess financial and insurance risks;
k. To transfer or assign our rights and duties under any governing terms and conditions between us and yourself;
l. To protect or enforce our rights to recover any debt owing to us;
m. For crime or fraud detection, prevention, and prosecution purposes;
n. For security, surveillance, and monitoring purposes;
o. To monitor and assess the performance and effectiveness of products and services;
p. To detect and prevent fraudulent activity;
q. For analytical purposes, including but not limited to data mining and analysis of your transactions with us, producing reports which have been anonymized or aggregated in a manner that does not identify you as an individual;
r. To investigate, respond to, and/or address complaints or incidents relating to our products or services, in compliance with the relevant law;
s. To better manage our business and your relationship with us;
t. For us to better understand the current, future needs, preferences, and interests of you, the rest of our customers, the market, and/or the industry in which you and/or we operate, for us to develop, enhance, and provide products and services to meet those needs, preferences, and interests;
u. To conduct research, surveys, and/or for customer satisfaction and other internal marketing analysis purposes;
v. To provide you with information about our products and services and/or products and services offered by other parties that we feel may interest you, unless you have otherwise opted-out;
w. To comply with our legal obligations and for any purpose incidental, ancillary or in furtherance of our business;
x. To maintain records required for security, claims, or other legal purposes;
y. To administer your participation in contests, games, sweepstakes, or similar promotions; and/or
z. For such other purposes in relation to your contract with SainoForce Technology as SainoForce Technology deems necessary or appropriate.

 

4. Disclosure of Your Personal Information
4.1 As a part of providing you with our products and/or services, or the management and/or operation of the same, we may be required or need to disclose information about you to the following third parties:
a. Companies and/or organizations that act as our agents, affiliates, business partners, and/or professional advisers;
b. Companies and/or organizations that assist us in processing and/or otherwise fulfilling transactions that you have requested;
c. Companies and/or organizations that assist us in providing value-added services that you have requested;
d. Our business associates and other parties for purposes that are directly related to the purpose of collecting your personal information;
e. Other parties in respect of whom you have given your express or implied consent;
f. Any credit reporting agencies or in the event of default, any debt collection agencies, subject to the permitted law applicable to us;
g. Any person, who is under a duty of confidentiality to which has undertaken to keep such data confidential, which SainoForce Technology has engaged to fulfill its obligations to you;
h. Any actual or potential assignee, transferee, participant, or sub-participant of SainoForce Technology’s rights or business; and/or
i. Any person to whom we are compelled or required to do so under law or in response to a legitimate instruction from a competent or government agency.

 

5. What If Personal Information Provided By You Is Incomplete?
5.1 Where indicated (for example in application forms), it is obligatory to provide your personal information to us to enable us to process your application for our products or services. Should you decline to provide such obligatory personal information, we may not be able to process your application/request or provide you with our products or services.

 

6. Your Rights To Access And Correct Your Personal Information
6.1 We can assist you to access and correct your personal information held by us. Where you wish to have access to your personal information in SainoForce Technology’s possession, or where you are of the opinion that such personal information held by us is inaccurate, incomplete, misleading, or not up-to-date, you may make a request to us by contacting us via the contact details set out in Section 9.3 below.
6.2 You may also update your personal information at any time by accessing your account on the SainoForce Technology Portal. However, any updates made to your personal information will be subject to validation and verification processes by us to ensure the information is accurate and complete.

 

7. Your Obligations
7.1 You are responsible for ensuring that the personal information you provide to us is accurate, complete, and not misleading and that such personal information is kept up-to-date.
7.2 In the circumstances where you may need to provide us with personal information relating to third parties (for example about your spouse, children, parents, and/or employees), you confirm that you have obtained their consent or are otherwise entitled to provide this information to us and for us to use it in accordance with this Privacy Notice.

 

8. Transfer of Your Personal Information Outside Malaysia
8.1 It may be necessary for us to transfer your personal information outside of Malaysia if any of our service providers or strategic partners (“overseas entities”) are involved in providing part of a product or service located in countries outside of Malaysia.
8.2 You consent to us transferring your personal information outside of Malaysia in these instances where we need to send your information to overseas entities, provided that these overseas entities have in place an appropriate level of protection to protect your personal information. If you do not consent to us transferring your personal information outside of Malaysia, you should immediately inform us via the contact details set out in Section 9.3 below.

 

9. Amendments to This Privacy Notice
9.1 We may review and update this Privacy Notice from time to time to reflect changes in the law, changes in our business practices, procedures, and structure, and the community’s changing privacy expectations.
9.2 While it is not generally feasible to notify you of changes to this Privacy Notice, the latest version of the Privacy Notice will be made available at our websites and/or other appropriate communication channels.
9.3 You can determine when this Privacy Notice was last revised by referring to the “Last Updated” date at the bottom of this Privacy Notice.
